Copyright & DMCA
Members post their own real moments. If something on Belavo is yours and was posted without permission, here is how to tell us.
1. Our policy
Belavo respects the intellectual property of others and expects members to do the same. Members may post only content they own or have permission to post, as the Terms of Service require. We remove or disable access to infringing content when we receive a valid notice, and we terminate the accounts of members who are repeat infringers.
2. Reporting copyright infringement (DMCA notice)
If you believe content on Belavo infringes a copyright you own or control, send a notice under the Digital Millennium Copyright Act, 17 U.S.C. §512(c)(3), to our designated agent:
Designated Copyright Agent
Dopin LLC d/b/a Belavo
Attn: Copyright Agent
254 Chapman Rd, Ste 208 #25323, Newark, DE 19702
Email: [email protected]
Designated with the U.S. Copyright Office DMCA Designated Agent Directory, registration DMCA-1084798.
Your notice must include:
- your physical or electronic signature, or that of a person authorized to act for the owner;
- identification of the copyrighted work you claim is infringed (or a representative list if several);
- identification of the material you claim is infringing and enough information for us to find it, such as the member's display name, city, and a description or screenshot of the photo or video;
- your name, address, telephone number and email address;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law; and
- a statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act for the owner.
Because Belavo profiles are visible only to members who are introduced to one another, you may have learned of the content from a member. We will act on a notice that identifies the content clearly even if you cannot provide a link. A person who knowingly materially misrepresents that material is infringing may be liable for damages under 17 U.S.C. §512(f).
3. What happens next
When we receive a complete notice we remove or disable access to the content promptly, notify the member who posted it, provide them a copy of the notice, and record a strike against the account. If the same member receives repeat notices, their account is terminated.
4. Counter-notice
If your content was removed and you believe it was removed by mistake or misidentification, you may send a counter-notice to the agent above containing:
- your physical or electronic signature;
- identification of the material that was removed and where it appeared before removal;
- a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification;
- your name, address and telephone number, a statement that you consent to the jurisdiction of the federal district court for the district in which you live (or the Northern District of California if you live outside the United States), and that you will accept service of process from the person who sent the notice or their agent.
We forward counter-notices to the original complainant. If they do not notify us within 10 business days that they have filed a court action, we may restore the content within 10 to 14 business days.
5. Other rights: your photo posted by someone else
If a member is using photos or videos of you, or of someone you represent, without permission (for example on a fake profile), you do not need a DMCA notice. Report the profile in the app under "Fake profile or stolen photos", or email [email protected] with a photo of yourself for comparison. Impersonation and stolen photos are banned under the Community Guidelines and are handled by Trust & Safety. Intimate images shared without consent are removed immediately and reported where the law requires.
6. Trademarks
"Belavo", the Belavo wordmark and logo are trademarks of Dopin LLC. You may not use them without written permission, except to refer to Belavo truthfully. Report trademark misuse to [email protected].
7. Belavo's own content
The design, text, graphics and software of the Belavo app and website are owned by Dopin LLC or its licensors and may not be copied, scraped or reused without permission, as the Terms of Service describe.
